Why, if Jerry Seinfeld owes me money for material his show used from a script I sent to them, did I not sue Seinfeld and his show ?  ANSWER: Unless a celebrity is sued by another celebrity, celebrities virtually never get found guilty of intellectual property theft or infringement, and virtually never get found liable for use of other people's copyrighted material by judges or juries in both the United States and Canada.  I am not a celebrity, hence it is virtually a certainty that a judge or jury would not rule in my favour against Jerry Seinfeld even with very strong evidence in my favour.

You can look up past court cases yourself, which I did, or you can call an American attorney that practices in the area of copyright infringement, which I did, and you will get the above answer; or you can ask a Canadian attorney that practices in the area of copyright infringement (which I am) and you will get the above answer.  If you are looking for a reason as to why non-celebrities virtually never succeed against celebrities in copyright infringement, theft, etc. cases, I'll tell you what I heard from an American attorney, he said that judges are people and juries are people, and all people adore celebrities, so at the end of the court case the judge or the jury wants to feel that the celebrity is their friend, and they can only accomplish that by siding with the celebrity.

Below are the facts about my claim that Jerry Seinfeld owes me money and that the media covered up for The Seinfeld Show.

On January 18, 1993, by Fed Ex overnight courier, I sent a letter and script to The Seinfeld Show.

On January 19, 1993, at 9:40 AM, at The Seinfeld Show's front desk reception, M. Kaiser signed for my letter and script.

The Seinfeld Show kept my script for two weeks and then sent it back to me.
The reassembled stamp clearly shows FEB-2'93.  If you find that the FEB is hard to see you can still see the -2'93.  The Seinfeld Show could not have sent my script back to me on January 2, 1993, 16 days before I sent it to them, therefore, you can be satisfied that they sent it back to me on the 2nd day of some month after January.
After receiving my script the most unique and creative new comedy concepts that were in my script appeared in two different Seinfeld episodes.

In the 1990's my legal research in Canada and in the United States very clearly demonstrated that members of the general public (such as myself) virtually never succeed in court against entertainment industry celebrities in a case of wrongful use of script or story or book material.  I was advised by an American lawyer who has tried cases against celebrities for wrongful use of material, that juries and judges are equally enamored with the celebrities and want to be (in their minds) friends with the celebrity and they cannot accomplish that by going against the celebrity in court.  I do not know whether or not that was an accurate explanation for celebrities virtually always winning in court against the public, but the statistics were clear, my chances of winning against Jerry Seinfeld and Larry David in court were statistically virtually zero.

In 1998 I wrote to The Seinfeld Show, they did not respond.  I wrote to The Seinfeld Show's lawyers, they did not respond.  In my experience as an attorney, lawyers do not respond when their client does not want to say anything in writing because they know they are guilty and hence don't want to put anything in writing.  If they deny clear facts, then they can be shown to be liars.  If they admit to a wrong doing then that proves they did wrong.  In my experience as an attorney, when a person has done nothing wrong and they are being directly accused of unauthorized use of material in another person's script, they or their attorney will at the very least send a brief denial letter; however, when they know they have done wrong they avoid answering to avoid putting a lie in writing and to avoid admitting the truth.  In the below story about Mike Myers you will see that the person making the accusation against Myers had no evidence, but that a rep for Myers disputed the accusation because Myers wanted to go on the record as saying it was not true.

In 1998 I sent letters and evidence to many newspapers and magazines demonstrating that The Seinfeld Show had used material in a script that I sent to them, and asking that they expose what The Seinfeld Show had done.  The newspapers and magazines had my name and were free to publish it so that who was accusing The Seinfeld Show would be known, in addition the newspapers and magazines had the documentary evidence of the Fed Ex receipt, a copy of my script, and transcripts of The Seinfeld Show's episodes that used the new and unique material that was in my script.  The newspapers and magazines also had the evidence of The Seinfeld Show's return post mark showing that they kept my script for two weeks.

All of the following news media that received my letters and documented evidence refused to expose what The Seinfeld Show had done.  (Where I list a fax number I sent my letter and documents by fax, where no fax number is listed I sent my letter and documents by regular mail.)  I also sent follow up letters and faxes, and again they refused to expose what The Seinfeld Show had done.

I am not providing a copy of my script because if I do then Jerry Seinfeld and Larry David will not have to answer for themselves, instead others will make comments for them and a great obfuscation will take place.

If Jerry Seinfeld or Larry David or both of them want to discuss the matter publicly with me, I will attend.

In 2016 and 2017 I sent Jerry Seinfeld registered letters, all of which were signed for; he did not respond.  In October of 2017 I sent him another letter stating that we could settle the matter with a comedy contest; I challenged Jerry Seinfeld to a comedy battle, he ignored my challenge.  Below is a copy of the registered letter receipt which Jerry Seinfeld signed; but he refused to reply.

If Jerry Seinfeld and/or Larry David want to settle the matter with a comedy battle, I will do battle against either or both of them.  I have no idea how I would fair in a stand up comedy battle as I've never done stand up; what I do know is that they used material I wrote and I've never had to use material that either of them wrote.

But nothing will ever excuse the media for their collusion and dishonest cover up.

The media will publish innocuous stories about celebrities, which make the celebrity look eccentric or interesting, or stories that the celebrities allow to be published.  The below story about Mike Myers has no corroboration; I provided documentary evidence to the media demonstrating that Seinfeld used material from my script without paying me; however, the media across North America refused to print what Seinfeld had done because that would make him look like a bad person, not simply an interesting eccentric character.

About five years ago I again contacted many of the above media to run the story and evidence exposing The Seinfeld Show; they all continued to refuse to run the story.

In my letter to Larry David I wrote that I was in the process of establishing myself as a writer.  I did work at pursuing becoming a writer when time permitted, however, time was very stingy with me, and many things came up which prevented me from pursuing becoming a writer.  The proposed "Magnum P.I. Movie" showed interest in my script for that movie, but then the studio cancelled that project and there never was a "Magnum P.I. Movie".  I also started writing a comic strip, but time prevented me from pursuing it; you can see a few of the comics I drew and wrote if you want to.
